Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the MARA Capstone exam preparation portal (the “Service”) operated by PrepWise Pty Ltd ABN [INSERT ABN]. By creating an account or using the Service, you agree to these Terms.

1. Service description

The Service is an exam preparation portal offering practice questions, written-answer drills, case studies, progress tracking, and a structured Learning Academy for the MARA Capstone assessment. The Service is a study aid only. It is not legal advice, is not affiliated with or endorsed by any regulatory authority, and does not guarantee any particular exam outcome.

2. Subscription and access

Access to the question bank and Learning Academy begins immediately upon account activation. Because digital content is delivered immediately, all sales are subject to our Refund Policy set out in section 3 below.

We offer four access tiers:

  • Demo — a free tier granted automatically upon account creation. Provides access to 3 sample questions across all question formats, with full AI examiner feedback. No payment is required. Demo access does not expire.
  • Trial Access — a paid entry-level plan providing access to 35 curated practice questions across all formats, AI examiner feedback, and progress tracking. The Learning Academy is available in locked-preview mode (module list visible; content requires a full plan). Access expires at the end of the selected exam intake month.
  • Capstone Ready — a full plan providing access to the Capstone Ready practice question bank and a set of held-out Exam Simulation questions with LTA-style timing, AI examiner feedback, full progress analytics, and the complete Learning Academy. Access expires at the end of the selected exam intake month. Current question counts are published on the pricing page and may be updated as new questions are added.
  • Complete Preparation — a full plan providing access to the complete practice question bank and a set of held-out Exam Simulation questions, AI examiner feedback, full progress analytics, and the complete Learning Academy. Access is for the exam intake period selected at the time of purchase. Current question counts are published on the pricing page and may be updated as new questions are added.

All paid subscriptions are tied to Legal Training Australia (LTA) exam intake months administered through our Exam Months system. Access expires at month-end for the covered intake month(s), regardless of usage. The expiry date is disclosed at the time of purchase.

The Learning Academy (including structured study guides, legislative research guides, written and oral exam tips, a glossary, landmark cases, decision trees, flashcards, and useful resource links) is included in full on Capstone Ready and Complete Preparation plans. Trial Access subscribers receive a locked preview of the Academy module list; full content access requires upgrading.

3. Refund Policy

A full refund is available if requested within 48 hours of purchase, provided you have not accessed any practice content or AI examiner feedback. Once content has been accessed, or once 48 hours have passed since purchase, refunds are not available. Our refund policy is outlined in full on our Refund Policy page. By subscribing you acknowledge you have read and agree to our refund terms.

4. Acceptable use

The Service is licensed for your personal use only. You must not:

  • Share your account credentials or allow others to use your account
  • Copy, scrape, harvest, republish or distribute any questions, answers or materials
  • Use automated tools to access, download or extract content
  • Resell, sublicense or commercially exploit any part of the Service

5. Intellectual property

All questions, answer frameworks, explanations and other materials provided through the Service are owned by PrepWise Pty Ltd ABN [INSERT ABN] or its licensors and are protected by intellectual property laws. You retain ownership of the written answers and responses you create; by submitting them you grant us a limited licence to process them to provide the Service (including optional AI feedback).

6. AI feedback disclaimer

Where offered, AI-generated feedback on written answers is indicative only. It is intended to help you reflect on your response and is not a definitive assessment, mark, or prediction of your exam result. You should not rely on it as an authoritative evaluation.

7. Accuracy of content

We make every reasonable effort to ensure that the practice questions, model answers, explanations and other materials provided through the Service are accurate and reflect current migration law and regulatory requirements. However, the law changes frequently and materials may not always reflect the most recent legislative amendments, policy updates or regulatory guidance.

The Service is provided on a best-effort basis. PrepWise Pty Ltd ABN [INSERT ABN] makes no warranty, express or implied, that any question, answer, explanation or other content is correct, complete or current at the time you access it. You should verify any answer or legal position independently before relying on it in a professional context. We accept no responsibility or liability for any loss, damage, incorrect exam outcome or professional consequence of any kind arising from inaccurate, incomplete or outdated content, whether or not that inaccuracy was known to us at the time of publication.

8. Limitation of liability

The Service is provided “as is” without warranties of any kind, to the extent permitted by law. We do not guarantee success in the MARA Capstone assessment or any other outcome. To the maximum extent permitted by law, PrepWise Pty Ltd ABN [INSERT ABN] is not liable for any indirect, incidental or consequential loss arising from your use of the Service. Nothing in these Terms excludes rights you have under the Australian Consumer Law.

9. Account termination

You may stop using the Service and request account deletion at any time. We may suspend or terminate your account if you breach these Terms — including misuse, credential sharing or scraping — without refund. On termination, your right to access the Service ends, subject to our Privacy Policy regarding data retention.

10. Account security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@maraprep.com.au if you become aware of any unauthorised use of your account. We are not liable for any loss arising from your failure to keep your credentials secure.

11. Modifications to the Service and these Terms

We may update or modify the Service, including its features, pricing and availability, at any time. Where changes are material, we will endeavour to provide reasonable advance notice by email or in-Service notification.

We may also update these Terms from time to time by posting the revised version with an updated “Last updated” date. Your continued use of the Service after the effective date of any update constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Service.

12. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable under applicable law, that provision will be severed from these Terms to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

13. Governing law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.
