Practising questions is the single highest-leverage thing you can do to prepare for the Migration Agents Capstone Assessment. But how you practise decides whether it actually raises your score — most candidates do questions the wrong way and wonder why exam day still feels overwhelming. Here are some samples to test yourself on, and a method that makes practice count.
Where official Capstone questions come from
Legal Training Australia publishes some sample questions on its website, and once you enrol you receive practice assessments with model answers plus practice quizzes on each of the nine Occupational Competency Standards, available through Canvas. Use all of those. But the official samples are limited in number — and building genuine exam speed takes far more volume and variety than they provide.
A few sample questions to test yourself
Try these before reading the answers. They're written in the style of the assessment and cover foundational material you're expected to know cold.
Question 1 — Constitutional basis Which section of the Australian Constitution gives the Commonwealth Parliament power to make laws with respect to "naturalisation and aliens"? A. Section 51(xxvii) B. Section 51(xix) C. Section 109 D. Section 75(v)
Answer: B. Section 51(xix) — the "aliens" power — together with Section 51(xxvii) covering immigration and emigration, provides the constitutional foundation for the Migration Act 1958.
Question 2 — Registration requirement Which of the following is required to register as a Registered Migration Agent with OMARA (for candidates relying on current qualification pathways)? A. A law degree and admission as a legal practitioner B. Completion of the Graduate Diploma in (Australian) Migration Law and Practice and a pass in the Capstone Assessment C. Five years' experience in an immigration role D. Membership of a migration professional association
Answer: B. The knowledge requirement is completion of the prescribed qualification and a pass in the Capstone Assessment.
Question 3 — The Code of Conduct Where is the Migration Agents Code of Conduct that RMAs must comply with currently set out? A. Directly in the Migration Act 1958 B. In the Migration (Migration Agents Code of Conduct) Regulations 2021 C. In non-binding OMARA guidance only D. In the Migration Regulations 1994, Schedule 2
Answer: B. The Code is contained in the Migration (Migration Agents Code of Conduct) Regulations 2021.
How to practise so it actually raises your score
Doing questions isn't the same as practising well. What separates candidates who pass:
- Practise under timed, exam-like conditions. The written assessment gives you three hours across two components — speed and time management are half the battle, so build them in from the start.
- Practise open-book the way the real exam works. The written is open-book with access to LEGENDcom. Get fast at locating things in your resources rather than reading from cold — fumbling for material burns time you don't have.
- Use active recall and spaced repetition, not re-reading. Testing yourself and revisiting weak material on a schedule embeds it far better than passive review.
- Diagnose by topic, not just by score. Track which of the nine Occupational Competency Standards you keep dropping marks on, and target those — a 70% overall can still hide a component you'd fail.
- Don't live only in multiple choice. The short-answer questions and the long case study carry most of the written marks, so practise structuring full written answers under time pressure, not just picking options.
